On July 5, 2023, an update to the Master Plan for Chopin Airport for the years 2021-2040 (the ‘Master Plan‘) came into effect, completely overturning numerous investment processes in the city of Warsaw and the surrounding municipalities.
However, this revolution did not truly begin until February 2024, when the administrative authorities adopted a specific interpretation of the data in the Master Plan concerning the area it covers, resulting in the conclusion that in significant areas of the left-bank Warsaw Agglomeration covered by the Master Plan, where there are no local spatial development plans in place, decisions on building conditions cannot be issued.
The situation appears to be a deadlock, as the authorities are constrained and cannot issue decisions for long-planned investments, the municipalities are not prepared to initiate work on procedural local plans, and the introduction of legislative changes is a long-term process.
In the upcoming issue of Prawo Budowlane. Kwartalnik, we will consider whether the administrative authorities have justifiably suspended (and are still suspending) the implementation of investments in areas covered by the Master Plan, as well as the implications of this for investors in the context of building permits issued based on decisions on building conditions granted after July 5, 2023.
